Trek Files Lawsuit to Recover Tariffs After Supreme Court Strikes Them Down

Trek is suing the US government to reclaim import duties after the Supreme Court struck down IEEPA tariffs, triggering a potential wave of refund claims and new uncertainty over what replacement tariffs come next.

​Trek Bicycle Corporation is suing the US government to recover import duties it paid under tariffs that have now been ruled unlawful by the US Supreme Court.

​Last week, the Court struck down global tariffs imposed under the 1977 International Emergency Economic Powers Act (IEEPA). The justices ruled that companies are entitled to refunds for the extra duties collected over the past year. However, the decision did not explain how or when those refunds will be issued, leaving businesses uncertain about next steps.

​Trek moved early. In December, the company filed a protective complaint with the US Court of International Trade, seeking repayment of the tariffs collected under IEEPA. The lawsuit also asked the court to stop further collection of the duties and to award interest and legal costs.

​The case was put on hold while the Supreme Court considered Trump vs VOS Selections Inc, a related case that addressed the legality of the tariffs and concluded last Friday.

​Other importers are now expected to follow. Billions of dollars were collected under the tariffs, and companies are looking to protect their right to refunds.

​Still, the broader impact remains unclear. President Trump has signaled he may introduce replacement tariffs under different authority, and past cases show that securing refunds can take time.
